From the article: The notices are being sent out under provisions of a federal law that authorizes citizens to force the enforcement of environmental laws. State and federal officials will have 90 days to decide whether they will pursue civil litigation or criminal charges. No lawsuit can be filed until authorities make their decision.

From the footnotes to the proceedings of a conference held at Duke University in 2000, see footnotes 1 and 2, and my recollection of Supreme Court cases, basically citizen suits on behalf of some environmental disaster or another now have significantly reduced ability to establish legal standing from which to argue the case :-\
